I think it is hypocritical to think that Phelps is the last person on Earth because he cheated on his wife. Most of those cops were abusive, lazy or corrupt - they had no right to judge him. Actually, I don’t think ruining his personal life makes him a bad cop. 

Agreed. In addition to that, I don’t condone cheating but I think if Cole didn’t cheat on his wife, his character would have been too perfect. I disagree with what he does but I think what happened with him and Elsa effectively adds to the story.
